According to SpaceNews, a coalition of environmental and scientific advocacy groups, represented by the legal nonprofit Earthjustice, formally petitioned the U.S. Federal Communications Commission (FCC) on July 8 to freeze all orbital data center applications.
NEPA COMPLIANCE MANDATE
The petition demands a Programmatic Environmental Impact Statement (PEIS) under the National Environmental Policy Act (NEPA). The coalition—including DarkSky International and Environment America—argues that the sheer volume of proposed launches threatens to degrade the ozone layer, pollute the night sky, and fundamentally alter the chemistry of the upper atmosphere. The filing asserts that a comprehensive review is the only way to determine if these mega-constellations serve the public interest before hardware reaches the pad.
SCALE OF DEPLOYMENT
While developers like Blue Origin, Starcloud, and Cowboy Space argue that space-based computing reduces Earth-side water and energy consumption, the scale of their ambitions is unprecedented. Documents reveal that SpaceX alone has proposed up to one million orbital data centers, while other competitors are seeking approvals for an additional 260,000 units.
REGULATORY CROSSROADS
Earthjustice senior attorney Jan Hasselman indicated that if the FCC fails to strictly adhere to NEPA mandates, the coalition is prepared for litigation. Although the FCC has recently tightened orbital debris rules—requiring a five-year deorbit timeline—it remains under intense pressure to accelerate licensing to maintain American parity with Chinese aerospace developments. This petition forces a confrontation between rapid industrial expansion and environmental preservation in the high frontier.
